These website terms and conditions are additional to, and should be read in conjunction with, all other terms and conditions that we may agree with you as part of your work with MedRecruit. Introduction
By accessing the MedRecruit Website or any other website operated by MedRecruit on which this notice is posted (hereafter the Website) you agree to be bound by the terms and conditions set out below. MedRecruit reserves the right to vary the information on the Website, including these Terms and Conditions, at any time without notice. Your continued use of the Website following any changes to the Terms and Conditions indicates your acceptance of those changes.
In the Website, a reference to MedRecruit, MedRecruit New Zealand, MedRecruit Australia, "us", "we" or "our" is a reference to any and/or all of MedRecruit Limited (New Zealand Company #1856984) or MedRecruit Pty Ltd (ABN #88144931457).

Membership Rights
The Website provides a service for registration as a user through the creation of an account. User accounts will be typically reserved for hospital staff, qualified doctors and medical students only. We reserve the right to exclude any person from account registration at our sole discretion.
If you are an individual who is an employee, shareholder or director of a 3rd party organization which is currently, or may reasonably be expected to become, a competitor of MedRecruit you are hereby excluded from the right to register through the creation of an account.
Lawful Purposes Only
You may use the Website for lawful purposes only. You shall not use the Website in such a manner that it may disrupt the use of any other person. You may not use any technology of techniques designed to circumvent user authentication/authorization or any other security measure.
Copyright in all information on this site, unless otherwise indicated, is owned by MedRecruit. The information provided by the Website to you may be proprietary in nature. You represent and warrant to us that you are not and shall not be a competitor of MedRecruit and agree not to share our confidential information with any competitors.
In some cases MedRecruit has procured a license to use certain content, images or video on the Website. Rights in this content remain the property of their original owner.
You shall not use any technology or techniques including but not limited to screen scraping designed to collect information, in bulk form, from the Website.
Links to Other Sites
From time to time the Website may link to other 3rd party websites. These links may be in the form of a clickable hyperlink or other approaches that include 3rd party content in pages on the Website. MedRecruit takes no responsibility for any information contained in these 3rd party websites. The content, accuracy and opinions expressed in such websites are not necessarily checked, monitored or endorsed by MedRecruit. Linking to a third party website does not indicate any endorsement of that website, its content or any associated organizations.
Privacy
MedRecruit is an Agency for the purposes of the Privacy Act 1993. All personal information that you supply to MedRecruit will be treated in accordance of that Act. In the course of providing you with our products and services, we may collect personal information from you. We will collect, hold and use your personal information in accordance with our
privacy policy. You have the right to ask to see information that MedRecruit holds about you and if you believe that the information is incorrect to ask that we correct it.

Partner Offers
From time to time we may make available offers from selected partners. We make no representations or warranties concerning these Partner Offers and you agree that we are not responsible or liable for any loss or damage of any sort incurred, or as the result of the delivery or display of the Offers. We are not responsible for the terms and conditions of Partner offers nor are we responsible for delivery of the goods or services. We make a good faith effort to screen all Partner Offers to provide the best experience for our members however we are not responsible for dealings between you and a partner organization. You are responsible for and must carefully read and assess the terms of any partner in light of your particular individual circumstances.
User Submitted Content
You are solely responsible for any content and other material that you submit, publish, display or link to the Website. This includes any files or images that you might upload. You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information on the Site. You are responsible for ensuring that any content that you post is in compliance with all local laws and regulations. You agree to indemnify us from any claims that may arise as a result of content that you have posted.
You agree that by posting any content or other material to the site you grant us an irrevocable, royalty free, worldwide, perpetual license to use that content.
We are under no obligation to publish content that you may provide us and reserve the sole right to determine if and when content is posted and removed.
Rewards Points
We offer a rewards points program to select persons. Participation in the rewards points program will be typically reserved for qualified doctors and medical students only. We reserve the right to exclude participants our sole discretion.
We give no warranty as to the continuing availability of the rewards points program and we reserve the right to terminate it by providing at least 14 days notice to participants.
We reserve the right to alter the nominal value of any points at any time and without notice.
Reward points have no cash value and are not transferrable for cash.
Unsolicited Electronic Messages Act 2007
The Unsolicited Electronic Messages Act 2007 aims to stem the flow of unsolicited commercial electronic messages. When MedRecruit sends you messages about our products, services or promotions it is because we believe you have provided either express or inferred consent for us to send these emails. MedRecruit would like to continue to keep in contact with you, however, should you not want to receive these messages, you should use our
contact us form to let us know.
Limitation of Liability
If you are dissatisfied with the Website, with any content on the website or with these terms and conditions then your sole and exclusive remedy is to discontinue using the Website.
Except insofar as any liability under statute cannot be excluded, none of MedRecruit, any of its employees and agents, or any other party accepts any responsibility or liability for any direct or indirect loss or damage that may result from any errors or omissions on the Website, reliance on information on the Website, or access to, the use of, or inability to use, the Website.
If, notwithstanding the clause above, a court of competent jurisdiction holds us (or any of our officers, employees or agents) liable in respect of any matter arising out of or incidental to your use of the Website or these terms and conditions, whether that liability arose in tort (including negligence), contract, equity or on any other basis, the total aggregate liability will be limited to NZ$1.00.
Governing Law
These terms and conditions are governed and construed in accordance with New Zealand law and when accessing this website you accept the exclusive jurisdiction of the New Zealand courts.
‘WIN A RETURN AUSTRALIA-NEW ZEALAND FLIGHT’ COMPETITION TERMS AND CONDITIONS
Entry is subject to the following terms and conditions:
1. Entry is available to doctors who are residents of the UK.
2. No Purchase Necessary
3. During the competition, the participant will obtain entries to the competition (All entries are non-transferable) through visiting the MedRecruit stand at the BMJ Careers Fair 2011, and having their ID tag scanned.
4. The competition closes on 1 October 2011 at 5 p.m. To enter you must have your electronic ID tag scanned.
5. There is one prize available. The winning prize consists of: One Adult return Trans Tasman (Australia, New Zealand return flight in any direction) to a maximum value of $1000 NZD.
6. The prize is valid for travel from 1 January 2012 to 31 December 2012. All components of the prize must be redeemed during these times. All components of the prize are subject to availability and must be booked in advance.
7. Travel to and from the airport, valid passports, departure taxes, domestic transport or transfers, New Zealand and Australia domestic transport or transfers, taxis, optional tours, vaccinations, visas, re-entry permits, spending money, meals and travel insurance, hire cars, taxi, petrol and all other ancillary costs are the responsibility of the winner unless otherwise stated.
8. Where a component of a prize is awarded in the form of a pass or ticket, the redemption of the prize is subject to the terms and conditions stipulated on the pass or ticket. The Promoters shall not be responsible for any pass/ticket/voucher which is lost, stolen, damaged, forged or tampered with in any way.
9. The prize (and any of its components) must be accepted as awarded, and cannot be transferred, taken separately or redeemed for cash. All aspects of the prize are non-transferable.
10. The Promoters reserve the right to substitute the prize in whole (or any of its components), with a substitute prize of equal or greater value.
11. All Prize travel will be subject to the chosen airlines Conditions of Carriage.
12. Entry into the competition is conditional on acceptance of these terms and conditions. By entering the competition, you are deemed to have read and accepted these terms.
13. The Promoters and any other person or party associated with this promotion shall not be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss or damage) or personal injury suffered or sustained in connection with either participation in this promotion or with any prizes offered, but liability for death or personal injury caused by negligence, or any other liability that cannot by law be excluded, is not excluded.
14. To be eligible, entries must be received on or before 5 PM on 1 October 2011. All entries shall become the property of MedRecruit Limited. The Promoters and their directors, officers, representatives, advertising and promotional agencies assume no responsibility for contacting or forwarding prizes to entrants who provide unclear or incomplete information, or for any lost, stolen, delayed, damaged or misdirected entries, or for any failure of the website during the promotional period, or for any problems or technical malfunction of any computer online systems, servers, access providers, computer equipment, software, failure of any entry to be received on account of technical problems or traffic congestion on the internet or any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. Any attempt to deliberately damage any website or undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Promoters reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically MV reproduced, mutilated, forged, falsified, altered or tampered with in any way. Entrants agree to abide by the contest rules and the decisions of the independent judging panel, which are final.
15. A prize draw will take place on the morning of 12 December 2011 to select the winner. The prize winner will be notified by telephone/email, and will need to respond by 11:59 pm 23 December 2011 as to whether they are able to accept the prize. If a selected entrant does not meet all of the contract conditions, another entrant will be selected from the remaining eligible entries. If MedRecruit, having used reasonable efforts is unable to contact a winner before 11:59 pm 23 December 2011, a new winner will be drawn and the original winner will forfeit his/her right to the prize.
16. In drawing selecting the winners, and in the event of any dispute or need for clarification, the promoter’s decision is final and no correspondence will be entered into.
17. The Promoters reserve the right to terminate or withdraw this competition at any time.
18. Entries must be submitted by the named entrant and will be invalid if found to come from a third party. Multiple entries from a single source will be disqualified.
19. By entering the contest, entrants consent to the use of their names, city of residence, photograph and/or image for publicity purposes in all media carried out by the Promoters, without payment or compensation.
20. The email address and phone number you provide to enter the competition will be used by the Promoters to contact you if necessary.
21. The Promoters are not the principal or service provider for any component of the prize. The prize has been organised in good faith and the principal provider and service providers shall be responsible for the prize.

23. This competition and its terms are governed by New Zealand law and are subject to the exclusive jurisdiction of the New Zealand courts.
